Overfuel's Role

Overfuel connects dealers with vehicle purchasers through software. Overfuel is not in the business of selling or servicing vehicles, but provides website access. Nothing on this site constitutes an offer to contract.

General Terms

Vehicles are sold as-is unless stated otherwise. Pictures may not represent the actual vehicle. Prices are subject to change at the dealer's discretion and exclude taxes and fees. Mileage listings are estimates. Users must verify options with the dealer. Information accuracy cannot be certified due to third-party data and model variability. Payment calculators provide estimates only, subject to lender approval.

Third-Party Links

The service includes third-party materials. Overfuel is not responsible for examining or evaluating the content or accuracy of third-party content, and disclaims liability for third-party transactions or harm.

User Comments, Feedback and Other Submissions

Users grant permission for submissions to be used without restriction — edited, copied, published, distributed, or translated. The company assumes no obligation to maintain confidentiality, compensate, or respond. Users warrant their comments don't violate third-party rights and don't contain illegal or malicious content. Users take full responsibility for accuracy.

Some jurisdictions may not permit all of these exclusions.

Digital Millennium Copyright Act (“DMCA”)

Overfuel respects intellectual property rights and responds to copyright infringement claims. A claim must include: a description of the work, its location with URL, the claimant's contact information, a good-faith statement, a penalty-of-perjury statement, and a signature.

Limitation of Liability

COMPANY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE LESSER OF USER'S ACTUAL PROVABLE LOSSES OR $100.

Exclusion of Consequential and Related Damages

COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, including lost profits or business interruption.

Time to File a Claim

NO CLAIM MAY BE BROUGHT BY USER UNDER THIS AGREEMENT MORE THAN ONE (1) YEAR AFTER THE CLAIM ACCRUED.

Severability

Unenforceable provisions are severed to the maximum extent permitted by law without affecting the remaining provisions.

Termination

Users may terminate at any time by notifying Overfuel or ceasing use. Overfuel may terminate without notice if a user violates these terms. Obligations that accrued prior to termination survive termination.

Entire Agreement

These terms constitute the entire agreement, superseding prior communications. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Governing Law and Venue

This service is governed by Indiana state law. Exclusive venue lies in the federal or state courts located in Marion County, Indiana.

Changes to Terms of Service

Overfuel reserves the right to update these terms by posting changes. Continued use of the service constitutes acceptance of the updated terms.
